This is an important section of the HORSES FOR CHAMPIONS LTD.  (referred to as "HFC") website (Website) and we ask you to please read it carefully. By using the Website you agree to be bound by the points covered below.

 

We reserve the right, from time to time, to change terms or post additional terms that apply to the use of the Website. You are expected to check these pages from time to time to take notice of any changes we make, as they are binding on you. Some of the provisions contained in these terms of use may also be superseded by provisions or notices published elsewhere on the Website.

The Terms are explained in question and answer format.

 

Who owns the Website and its content?

 

It is owned and operated by HORSES FOR CHAMPIONS LTD. Limited with company registration number 9321631 and registered office address at 3rd Floor, 14 Hanover Street, Mayfair, London W1S 1YH.

Save in respect of Content generated by users or advertisers, where this is permittted from time to time, HFC or any third party licensors own all materials displayed on the Website including all trade marks, trade names, copyrights, designs, text, graphics and videos (Content).

 

Users or advertisers shall retain all copyright and any other rights over any video Content which they may submit to, or post or display on, the Website. By submitting, posting or displaying user generated Content, users grant HFC a perpetual, irrevocable, world-wide, royalty-free licence to reproduce, adapt, modify, translate, publish, publicly perform or display and distribute such Content on or through the Website or otherwise in connection with HFC´s business (including, without limitation, its promotion and marketing). Users submitting, posting or displaying the user generated Content also understand and agree that HFC may (a) transmit or distribute such Content over various public networks and in various media and formats, and (b) make such changes to the Content as may be necessary from time to time to conform such Content to the technical requirements of connecting networks, devices, services or other media.

 

How should I use the Website?

 

Access to the Website is free of charge. Limited video content is also available free. However the majority of video content is available to paid subscribers only (details are set out below). You may retrieve and display the Content on a computer screen or other devices which access the internet, download a limited selection of video and audio content (where a download option is indicated on the Website) and electronically copy or print pages of the Website for your own personal, non-commercial use. It is an infringement of copyright to pass video material onto other users or locations, by any means. The exception to this is where a video is free and an embed option is indicated on the Website.

 

All community areas provided on the Website are designed as a helpful, encouraging and informative resource to all users. We are, therefore, keen to ensure that all users of the Website abide by a few simple rules. These are as follows:

 

  • All content you provide or post must not infringe any copyright, trademark, trade secret or any other personal or proprietary rights of any other person.

  • Please avoid excessive shouting (use of all capital letters) or flooding (posting of repetitive text).

  • Please do not:

    • post any libellous or defamatory comments or any comments which are offensive or insulting or unlawful expressions of racism or hatred;

    • post anything relating to any ongoing or pending trial;

    • use profanities, advertise or solicit or impersonate others;

    • "stalk" or otherwise harass others;

    • post or use computer programs which contain disruptive features such as viruses, worms, trojan horses or similar;

    • interfere or disrupt the Website or servers or networks connected to it.

  • With regard to video comments which address the techniques or methods demonstrated, please do not post anything you would not want to say in person to the person/s in the video, as they read and respond to users comments.

 

We are not responsible for the content of the community areas and do not accept any liability for its accuracy. That responsibility lies solely with users since you are the ones creating the content. Save where it is clearly evident that a specific opinion or view originates from HFC, the opinions and views expressed in the community areas do not necessarily reflect those of HFC (indeed HFC may hold no or entirely different opinions or views).

 

We cannot and do not review every post before it appears on the Website. HFC operates a "notice and take-down" policy – which means that if HFC notices or is made aware of a post that contravenes the rules set out above. We reserve the right to (i) amend, edit or remove it, and (ii) if we feel it is necessary, bar the user from using the Website and, if relevant, cancel their subscription. We encourage you to therefore contact us if you feel that a post violates our rules in any way.

You also grant us a free, perpetual licence to republish any post, or other material you submit to the Website and shall indemnify us for any losses we suffer as a result of any breach(es) of the rules set out above.

 

Finally, from time to time, the Website may publish videos or features which some visitors may find offensive. HFC does not intend to offend and suggests that visitors who find the tone or content of the Website (or any part(s) of it) offensive, no longer visit the Website. No responsibility is taken for any offence caused.

 

What about links and banner advertisements available from the Website?

 

Where our site contains links to other sites, resources provided by third parties and advertisements, these links and advertisements are provided for your information only. We have no control over the contents of sites or resources you may be re-directed to, and accept no responsibility for them or for any loss or damage that may arise from your use of them.

 

Horse Hero Shop

 

Specific terms relating to the Horse Hero Shop can be found at www.horsesforchampions.com/hfc-shop. The terms of HORSES FOR CHAMPIONS LTD. apply in addition, as are appropriate.

 

How do I pay for chargeable content on the Website?

 

As referred to above, you need to pay a subscription to watch all of the Website's videos. You must Register on the Website first, then you can subscribe. The cost is clearly indicated and includes VAT. The Website's payment service provider is Paypal. By entering your payment details you agree to purchase a Subscription. We may at our sole discretion change the subsequent subscription fee. If we do this, we will notify you by email. You can cancel future Subscription payments at any time by notifying Paypal. Please note, while we do not administer cancellations, there is a link to cancel in My Details. Horse Hero does not offer refunds on Subscriptions. If you do not wish to subscribe, you can also purchase individual videos on Horse Hero. You will find the cost on the video page.

 

Does HFC hold any information about me and my visits to the Website?

 

We collect and process certain information about you and your visits to the Website in accordance with our privacy policy. By using our site, you consent to this and confirm that all data provided by you is accurate.

 

To what extent can HFC be liable?

 

HFC is about increasing the knowledge of horse care, well being and training, as well as providing an insight into the equestrian world and its top performers and leading professionals. Consequently, every effort is made to create content of the highest quality regards advice and information, as well as production standards. However, the techniques and methods demonstrated in our videos are based on the experience and practices of those demonstrating and presenting. Furthermore, users must appreciate that there is a wide range of practice in the equestrian community and, consequently, no one way is the ‘right’ way. The Website, therefore, recommends that users seek expert help and advice from third parties if they are in any doubt as to what is best practice from them and their horse/s. Whilst Horse Hero prefers the riders it works with to wear protective clothes and head gear, it is their choice and the site does not prescribe this as a condition of working with Horse Hero. Conversely, users must make their own decisions regarding their own use of protective clothes and headgear.

 

HFC shall not be liable to users for reliance by them on any information as advice, whether in video content or other areas of the site, and responsibility for safety when applying information taken from Horse Hero videos, is down to each individual.

The Website also recommends that users put the safety of themselves, their horses and others, first at all times. If professionals featured in Horse Hero videos, for instance, do not wear hats when they are riding, or body protectors when jumping when they are jumping, this in no way implies Horse Hero endorses these practises. The safety of users and their horses explicitly lies with users themselves.

 

Please note that Information contained in other Website videos such as interviews and yard tours, reflect the opinions and experience of the persons presenting and being filmed. Such content is designed for interest, inspiration and insight.

 

To the extent permitted by law, we and third parties connected to us hereby expressly exclude:

 

1.      All terms which might otherwise be implied or incorporated by law (ie via statute).

2.      Any liability for any direct, indirect or consequential loss or damage incurred by any user in connection with the Website or in            connection with the use, inability to use, or results of the use of the Website, any websites linked to it and any materials posted          on it, including, without limitation any liability for:

  • loss of business;

  • loss of profits or contracts;

  • loss of anticipated savings;

  • loss of data;

  • loss of goodwill;

  • wasted management or office time; and

  • for any other loss or damage of any kind, however arising and whether caused by breach of contract or otherwise.

 

This does not affect our liability for death or personal injury arising from our negligence, or any other liability which cannot be excluded or limited under applicable law.

 

What law governs the Website and the use of it?

 

The English courts will have exclusive jurisdiction over any claim arising from, or related to, a visit to the Website although we retain the right to bring proceedings against you for breach of these conditions in your country of residence or any other relevant country. These terms of use are governed by English law.
